1. Acceptance of Terms
By downloading, installing, or using the NailTech mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
NailTech is an AI-powered image editing application designed for enhancing nail photography. The Service allows users to upload images, apply AI-driven enhancements, and export the results.
3. Eligibility
You must be at least 13 years of age to use the App. By using NailTech, you represent and warrant that you meet this age requirement. If you are under 18, you confirm that you have obtained consent from a parent or legal guardian.
4. User Accounts
Certain features of the App may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account.
5. Subscriptions & Purchases
5.1 In-App Purchases
NailTech may offer subscription plans and one-time purchases through the Apple App Store. All payments are processed by Apple and are subject to Apple's terms and conditions. We do not handle or store payment information directly.
5.2 Renewal & Cancellation
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time through your Apple ID settings.
5.3 Refunds
Refund requests are handled by Apple in accordance with their refund policies. We are unable to process refunds directly.
6. Acceptable Use
You agree not to use the App to:
- Upload content that is illegal, harmful, or infringes on the rights of others
- Attempt to reverse-engineer, decompile, or disassemble the App or its AI models
- Use the App for any automated or bulk processing beyond its intended purpose
- Interfere with or disrupt the App's servers or infrastructure
- Impersonate any person or entity or misrepresent your affiliation
We reserve the right to suspend or terminate your access if you violate these terms.
7. Intellectual Property
7.1 Our IP
The App, including its design, code, AI models, branding, and content, is owned by NailTech and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our written permission.
7.2 Your Content
You retain full ownership of any images you upload to the App. By using the Service, you grant us a limited, temporary licence to process your images solely for the purpose of providing the enhancement service. This licence terminates immediately upon processing completion.
8. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or that AI enhancements will meet your specific expectations or requirements.
9. Limitation of Liability
To the maximum extent permitted by applicable law, NailTech and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising out of or in connection with your use of the App.
Our total liability for any claim arising from or related to these Terms shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless NailTech and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.
11. Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Your continued use of the App after any changes constitutes acceptance of the revised Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
